The following items are incorporated into all job quotes, bids and invoices for roofing jobs.
GENERAL

Any difference between these Terms and Conditions and the job quote, bid or invoice shall be governed by these Terms and Conditions and not those provided on the quote, bid or invoice.

These Terms and Conditions are subject to update and changes at any time and at the discretion of HCGRS.

Changes to Terms and Conditions will affect all outstanding and pending quotes and bids, but shall not affect any job-in-progress or outstanding invoice(s).
MATERIALS
Oil Canning
-
Oil Canning is the common term for when flat surfaces reflect or display a slight waviness
-
Oil canning is caused by Steel Mill production stresses and tolerances of formed products
-
Oil Canning can be caused by installation conditions, improper or un-level substrate, stresses introduced by the pressure of the fastners, cutting, slitting, and/or perforating of the metal, etc

Oil Canning can be caused by temperature and environmental changes

While any "Cold Steel Formed Product" is subject to Oil Canning, any roll formed (coil) product can be subjected to Oil Canning due to the stress induced by the rolling of the coil

Oil Canning is not, shall not, will not be accepted for/as a reason of rejection of materials

Oil Canning is not, shall not, will not be an acceptable reason for rejection of field installation

Oil Canning is not, shall not, will not be an acceptable reason for withholding of payment, all or part
-
Since many uncontrollable factors can lead to oil canning, HCGRS assumes no responsibility for the cost of actions taken in response to an oil canning condition.

A quick note about GALVALUME: uniform visual appearance of acrylic-coated galvalume panels cannot be guaranteed. Visual appearance elements include, but are not limited to; color, oil canning, shadow spots, spangle and striping. Non-uniform surface appearance of any visual element may occur over time.These changes do not represent a deficiency in the material, nor does it affect any warranties which may be in place, nor is it a reason for rejection.
Warranty

All materials are covered by manufactures warranty (and/or guarantee)

Manufactures normal material warranty do not provided for the merchantablity or fitness of any material for any particular purpose

Some manufactures require installations to be inspected by one of their company representatives/agents before providing their warranty, HCGRS will work with builder, customer/owner and manufacture to comply with all requirements in order to secure final warranty for customer/owner

Terms of warranty can be provided upon written request to either the manufacture or HCGRS

HCGRS does not warranty or guarantee any material for any use
WORKMANSHIP

HCGRS will contract with individuals (sub-contractors) to perform all installation work in a professional manner and consistent with HCGRS and Manufacture guidelines
Workmanship Warranty

HCGRS will warrant to the original customer/purchaser/property owner that all installation procedures will be free from all workmanship defects for a period of ten (10) years from the date installation was completed
Workmanship Warranty Conditions and Limitations

The above warranty covers HCGRS employee, agent and/or sub-contractor workmanship only

Any warranty work will be performed without charge to the original customer/purchaser/property owner
-
Warranty work shall be any work performed by HCGRS employees, agents, sub-contractors or representatives at the request of the original customer/purchaser/property owner, provided the individual is the current owner of the property on which the Warranty work is requested and it is determined by HCGRS that such work is covered by the terms of the warranty

Determination of Warranty work shall be made in good-faith by and at the sole discretion of HCGRS employees, agents, sub-contractors or representatives

Warranty work shall be performed by HCGRS employees, agents, sub-contracts or representatives only
-
In the event of a workmanship defect, please contact HCGRS by phone or writing, immediate contact is important and may prevent further damage

This warranty is null and void if any additions, alterations, repairs installations of satellite dishes, antennas, utilities are made on or through the roof or to any area or surrounding area affecting the roof, other than those performed by HCGRS or approved in writing by HCGRS

HCGRS shall under no circumstances be liable for damage to the substrate (deck and insulation), the structure itself, contents of the structure, any other property, injury to persons or for any consequential damages or incidental damages or loss of any kind whatsoever, whether in contract or tort, including negligence

During the term of this Warranty, HCGRS employees, agents, sub-contractors, and/or representatives shall have free access to the roof during regular business hours to perform appropriate inspections and/or repairs

This warranty is non-transferrable, non-assignable to any other party unless approved in advance and in writing by HCGRS and the cost to process the transfer and to inspect and repair the roof, if necessary, are paid for by the original customer/purchaser/property owner

HCGRS Workmanship Warranty shall not take effect, and HCGRS shall have no liability under this warranty, until all bills and/or invoices for materials, installation labor, supplies, and services have been paid in full to HCGRS and to all non-HCGRS material suppliers

No verbal Warranties, express or implied, are valid or enforcable
-
Any written Warranty contrary or in difference to this warranty must be signed and dated by HCGRS's President and Customer

This warranty is the only express warranty provided by HCGRS related to Workmanship
BIDS and QUOTES

Bids are formal written quotes
-
Prices in Bids are good for three (3) days from the date written
-
Quotes are informal verbal quotations and are not valid unless put into Bid form
-
Prices in Quotes are not finalized, may be "rough", and/or approximations of what a Bid would be and may vary significantly from final Bid based on many factors including, but not limited to, price changes in materials due to timing between obtaining a Quote and finalizing a Bid

Bids that do not contain terms for a "Work-in-Progress" or "Job-in-Progress" draw shall be due and payable upon job completion.

Bids that do have terms for a "Work-in-Progress" or "Job-in-Progress" draw, shall be due and payable upon submission of a "Job Draw Request" by HCGRS with final payment due upon completion.

Bids outside of HCGRS normal operating area will typically contain only one (1) trip unless otherwise stated in the bid.

Rotten wood, substandard substrate, items not otherwise specifically included in the Bid shall be add-on at HCGRS cost
CUSTOMER RESPONSIBILITIES
- Customer/Purchaser/Property Owner assumes all responsibility for insuring that all roof trussing and supporting structure meets or exceeds all city, county and state codes and guidelines applicable to their property.
- Customer/Purchaser/Property Owner is responsible for bid/quote review and making sure that the bid/quote reflects the scope of work that they are requesting from HCGRS.
- Customer/Purchaser/Property Owner is responsible for communicating all changes to plans or modifications to roofing trusses, roofing substrate, or other aspects that are related to or impact work bid/quote from HCGRS in a timely manner.
- Customer/Purchaser/Property Owner is responsible for any additional cost outside of the bid/quote due to changes or modifications made on-site and not represented in the original bid/quote. Pricing for these additional cost will be solely set by HCGRS based on current cost of materials, labor and overhead.
- Customer/Purchaser/Property Owner is responsible for additional trip charges should work site not be ready for HCGRS employees, agents, sub-contractors or representatives or due to changes and/or modifications outside of the original scope of work.
